The first part is relevant, but there's established law on it, and if there's enough ad revenue to be fought for (which obviously Nintendo is assuming there is) I just don't see what legal argument Nintendo could angle in order to subvert current fair use precedent. This is all just out of my ass, so take that for what you will.
The second part is... Not the argument you're making it out to be. I'd need to study their balance sheet, and get an idea of their normal variance, but it's pretty clear that Nintendo isn't being very calculating or playing a long game from their own press releases. I remember this being very blatant in the release explaining why they couldn't sell the consoles for a loss like their competitors were.

the more general subject for the idea of "non Euclidean geometry" is called "Topology".
It is a very recent field of mathematics (late 20th century, which is hell of current for math) that is about seeing what can be learned from the most basic properties of sets.
A Topology is a set (could be of numbers, could be of anything at all) along with enough information to define what subsets of it are "open". That is all. A Topology is often called a "space"
All of the familiar sets of numbers (the ever so misnamed "Real Numbers", "Complex Numbers", Integers, "Rational Numbers" etc...) are specific examples of different Topologies.
Since a Topology is such an unconstrained definition, usually one works with more specific kinds of topologies which add more requirements. One of the most important is the idea of a Topology which is a "Metric Space". A Metric space is a Topology which adds the notion of there being a way to compute a "distance" between any two points (there is of course a rigorous definition for how this notion of distance must operate in order to make sense).
Euclidean space is a very specific kind of a Metric Space where the rule used to compute distance is the good ole' Pythagorean theorem. But there are as many different metric spaces as you could imagine and more.
The basic study of Topology is often about figuring out in what ways that set can be changed (or "transformed") that still preserves its basic properties. An example of such a basic property for a Metric Space is whether or not the space is "Connected" (all the points are in one blob) or "disconnected" (different discrete blobs with no path between them). The study of how one space can (or cannot) be transformed into another (sometimes called being "mapped". eg: "space A is mapped onto space B by way of this function") is called "Differential Geometry".
An example of where differential geometry comes up is proving that there is no way to map a sphere onto a plane in a way that that does have "tears" (is continuous) and doesn't just throw away any points on the sphere. At a very fundamental level, a Sphere and a Plane are Spaces with very different properties.

On one hand I've heard a few bad news things for them recently. WiiU isn't doing as well as they hoped, EA isn't going to bother with WiiU, this is going to hurt their image. On the other hand, Nintendo is a very resilient company, and there are a shit ton of fans that will buy a shit ton of Nintendo products, and a shit ton of really high value IP. They also have handheld dominance (I wonder what the increasing ubiquity of smart phones is/will be doing). I'm no video game industry expert, though, so I have no idea what that means, how much their reputation and IP will protect them.

Obviously billable hours for associates is a bit different than a contracted attorney, but again, I was just using it for ease of metaphor, I don't have a very strong opinion hourly vs salaried, just my anecdotal experiences/relayed horror stories, and have my own preference.
the cool thing about Topology is that someone can dive into it without several years of calculus and diffEQ and linear algebra as background necessary to even understand what is being talked about.
The proofs are about basic properties of Topologies and, while by no means easy at all, don't require a lot of background terminology.
Though there is a limit to how far you can go without the background. Once you get into transforming spaces (Differential Geometry) you need calc and DiffEQ for the transforms.

Though, even if the games were available on systems I owned, I think the direction they have taken since the n64 would drive me off.
The "tutorial" section for a Zelda game should consist of "It's Dangerous To Go Alone, Take This". That is all.
Every time I've sat down to play any of the GC or Wii zeldas I give up in frustration while some annoying-as-fuck NPC is forcing me to sit through ages of poorly written exposition and tutorials on how to swing the damn sword.

I'm just saying that from a business analyst viewpoint (and I'm not very informed, just gauging my opinion on whats been mentioned in passing in chat, I haven't even gone to the specific page.) they aren't the strongest company in that market space. They also are on the wrong end of a lot of bad trends for any corporation. I'd need to study it a bit more, but I'm confident that the statement, "Nintendo's best days are behind them." will prove true.
